Off-duty ICE agent shot after allegedly assaulting elderly man at California home

An off-duty Immigration and Customs Enforcement (ICE) agent was hospitalized after being shot by a 72-year-old homeowner who police say opened fire after the agent allegedly assaulted him and his daughter in Fresno, California, early Friday.

The incident happened around 3:19 a.m. near East Dudley and North Broadway streets, according to the Fresno Police Department, which received several 911 calls reporting a gunshot.

Police said the homeowner’s daughter arrived home and found 32-year-old David Gonzalez sleeping on her front lawn. She alerted her father, who went outside to tell Gonzalez to leave.

When Gonzalez woke up, he appeared intoxicated and agitated, police said. He allegedly assaulted the 72-year-old man, causing visible injuries and forcing him to the ground.

The homeowner’s daughter tried to intervene to protect her father, but Gonzalez allegedly attacked her as well, causing her to fall to the ground, fearing for their safety, the elderly man pulled out a gun and shot Gonzalez, according to investigators.

The daughter’s boyfriend, an off-duty police officer, arrived shortly afterward and placed Gonzalez in handcuffs.

When officers reached the scene, they found Gonzalez with a gunshot wound to his midsection. He was taken by ambulance to a local hospital, where he is receiving medical treatment.

Gonzalez, who is from Texas, was identified as a federal agent assigned to ICE. Police said he remains in custody on suspicion of felony assault while receiving treatment.

The homeowner who shot Gonzalez is not facing criminal charges because he legally possessed the firearm used in the shooting, according to police.

Authorities said the injuries to the elderly man and his daughter were still being evaluated. Police have not established why Gonzalez was in the neighborhood, and it remains unclear whether he was alone at the time of the incident.

Investigators are seeking additional witnesses and video footage to help establish what happened. The investigation is ongoing.
