Pentagon threatens demotion of Sen. Mark Kelly over “seditious” video

The U.S. Department of War has issued a formal Letter of Censure to Senator Mark Kelly, warning that he could face further administrative action or criminal prosecution over public statements urging servicemembers to refuse orders.

The action was announced on Monday, when Secretary of War Pete Hegseth said the department initiated proceedings that could reduce Kelly’s retired military rank and cut his pension.

Hegseth said Kelly participated in what he called a “reckless and seditious” video and repeatedly characterized lawful military operations as illegal while encouraging members of the Armed Forces to disobey orders. He said Kelly remains subject to military justice as a retired officer receiving pay.

“Therefore, in response to Senator Mark Kelly’s seditious statements — and his pattern of reckless misconduct — the Department of War is taking administrative action against Captain Mark E. Kelly, USN (Ret),” Hegseth said.

The Letter of Censure states that if Kelly “continues to engage in conduct prejudicial to good order and discipline,” he may be subject to criminal prosecution or additional administrative penalties. The letter will be placed permanently in Kelly’s official military personnel file.

Hegseth said Kelly has 30 days to submit a written response and that the retirement grade determination process will be completed within 45 days. He said Kelly’s status as a sitting U.S. senator does not exempt him from accountability.

Kelly rejected the decision, accusing Hegseth and President Donald Trump of attempting to intimidate him for exercising his constitutional rights.

“Over twenty-five years in the U.S. Navy, thirty-nine combat missions, and four missions to space, I risked my life for this country and to defend our Constitution – including the First Amendment rights of every American to speak out,” Kelly said.

“If Pete Hegseth, the most unqualified Secretary of Defense in our country’s history, thinks he can intimidate me with a censure or threats to demote me or prosecute me, he still doesn’t get it,” Kelly said. “I will fight this with everything I’ve got.”
