2 ex-NYPD officers charged with robbing, groping sex worker while on duty
Two former New York City police officers have been charged in federal court after prosecutors said they stole from and groped a sex worker while the officers were on duty in Queens.
The indictment, unsealed Tuesday in Brooklyn, charges Justin McMillan and Justin Colon over an incident prosecutors on July 2024, when the officers responded to a complaint about prostitution inside a residential building on 89th Street near Roosevelt Avenue in Jackson Heights, a neighborhood in Queens.
According to court documents, McMillan and Colon turned off their body-worn cameras after arriving at the building and stole a key to the entrance from a woman who had just left the property. Prosecutors said the officers did not report the encounter and continued their patrol.
About eight hours later, at about 4:50 a.m. on July 20, prosecutors said the officers returned to the building, used the stolen key to enter and found a woman engaged in a sex act with a customer. The customer ran away, leaving the woman naked and alone in the dark with the officers.
Prosecutors said Colon acted as a lookout while McMillan stole money from the woman’s purse and groped her breast and buttock. The woman then fled, and the officers returned to patrol before eventually going back to the stationhouse, according to the charging documents.
Both resigned from the NYPD in March 2025, according to the U.S. Attorney’s Office for the Eastern District of New York.
The indictment charges both men with felony conspiracy against rights and willfully depriving the woman of her constitutional rights under color of law, a charge used when public officials are accused of violating someone’s rights while acting in an official capacity. McMillan is also charged separately with deprivation of rights for the alleged sexual abuse.
McMillan and Colon are under arrest. If convicted, each could face up to 10 years in prison.
